Regulamin

These Terms of Service ("Terms") govern your use of the website priormile.com and the vehicle history reports, VIN decoding and related services we offer (together, the "Service"). The Service is operated by Infranova Limited, a company incorporated in the Hong Kong Special Administrative Region, registered office 3 Salisbury Road, Tsim Sha Tsui, Kowloon, Hong Kong (the "Operator", "we", "us"). We sell to buyers in the United States. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

1. VIN decoding and free preview. You can enter a 17-character vehicle identification number (VIN). We decode it and show a free preview: the vehicle as described by the VIN and the number of records we hold in each report section. The preview is free and requires no account.
2. Vehicle history report. For a fee you can buy a full report for one VIN, or a pack of reports that you can spend on VINs of your choice. A report compiles records from third-party sources - including a licensed provider of official title records from the national title database, the National Highway Traffic Safety Administration (NHTSA), the National Insurance Crime Bureau (NICB), insurers, auctions and dealer listings - into one document, delivered on screen and as a PDF by email.
3. Not a government document, not an inspection. A report reflects the records available to us at the time it is generated. It is not an official title document, it does not certify the condition of a vehicle, and it does not replace a physical inspection by a qualified mechanic or a check with the motor-vehicle authority of your jurisdiction.

2. Who may use the Service

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract. If you use the Service on behalf of a business, you confirm you are authorised to bind that business.

3. Orders, prices and payment

1. Prices. All prices are in US dollars (USD) - the same price wherever you buy from - and are shown before payment. Prices include value-added tax where we are required to charge it; the tax amount is itemised at checkout and on your invoice. Business buyers in the EU may enter a valid VAT identification number for reverse-charge treatment.
2. Contract. Your order is an offer to buy. The contract is concluded when we confirm payment and begin generating the report. We send an order confirmation and an invoice to the email address you gave.
3. Payment. Payment is processed by a third-party payment provider. We do not store your full card number. Payment methods available at checkout may vary by country.
4. Packs. A pack is a balance of reports. Packs do not expire. Each report you open from a pack counts as one report purchase for the purpose of these Terms and the Refund Policy.
5. Digital content and withdrawal. Reports are digital content delivered immediately. By ordering, you ask us to start delivery at once and acknowledge that, to the extent your local law provides a statutory right of withdrawal for distance contracts, you lose that right once the report has been generated. Our voluntary Refund Policy applies in addition to any rights that cannot be waived.

4. Access to your reports

Reports are available on screen immediately after payment and through a link sent to your email address. You can open your reports without a password by requesting a sign-in link to that address. Reports remain available online for at least 90 days after purchase; the PDF you receive by email is yours to keep. You are responsible for the security of your email account.

5. Permitted use

You may use reports for your own purposes: evaluating a vehicle for purchase, sale, financing, insurance or trade-in, or, for businesses, as part of your own appraisal or sales work. You may share a report with people involved in the same transaction.

You may not:

• resell reports or report data, or offer them as part of a competing service;
• scrape, crawl or bulk-query the Service, or use automated means to submit VINs beyond normal personal or business use;
• use the Service to identify, locate or contact a natural person, to make decisions about a person's eligibility for credit, insurance, employment or housing, or for any purpose that would be governed by the US Fair Credit Reporting Act or the Driver's Privacy Protection Act - the Service is not a consumer reporting agency and does not provide consumer reports;
• remove notices, alter reports, or present an altered report as ours;
• interfere with the Service or attempt to access it other than through the interfaces we provide.

We may rate-limit, suspend or terminate access that violates these Terms.

6. Data sources and accuracy

Records in a report come from third parties. We do not create them and cannot verify each one independently. Records may be incomplete, delayed, mis-keyed at the source, or missing entirely - a report that shows no accident record is not a guarantee that no accident occurred. We work to present the data accurately and to name the source of each record. If you believe a report contains an error on our side (for example, records of a different VIN), contact us within 14 days and we will re-run or refund the report as described in the Refund Policy. Where our free preview holds no history records for a VIN, we do not sell a report for it at all.

7. Intellectual property

The Service, its design, text, software and the compilation and presentation of report data are owned by the Operator or its licensors and protected by copyright and other laws. You receive a limited, non-exclusive, non-transferable licence to use the reports you purchase as described in section 5. Trademarks and names of data sources belong to their owners.

8. Availability and changes

We aim to keep the Service available at all times but do not guarantee uninterrupted availability. We may change, suspend or discontinue features. If we discontinue the Service, reports you have purchased remain available for download for at least 30 days after notice, and unused pack balances will be refunded.

9. Liability

To the fullest extent permitted by law:

• the Service and reports are provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded;
• we are not liable for decisions you make on the basis of a report, including buying or not buying a vehicle, or for loss of profit, loss of business or indirect or consequential loss;
• our total liability to you for any claim arising from the Service is limited to the amount you paid us for the report or pack concerned in the 12 months before the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under the law that applies to you. If you are a consumer, you keep the rights granted by the mandatory consumer-protection law of your country of residence.

10. Privacy

How we handle personal data is described in our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms. The version and effective date are shown at the top of this page. Material changes take effect 14 days after we post them; your continued use after that date means you accept the new Terms. Purchases are governed by the Terms in force when the order was placed.

12. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, where the Operator is established, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes will be brought before the competent courts of Hong Kong; if you are a consumer in the EU or the UK, you may also bring proceedings in the courts of your country of residence, and you may use the EU online dispute resolution platform. Before going to court, please write to us - most issues are resolved by email within a few days.
